Terms of Service

These terms are the agreement between you and Alan Wizemann, LLC, a Delaware limited liability company ("we", "us"), for your use of InControl. We've written them in plain English on purpose. If something here isn't clear, email hello@getincontrol.com and ask.

1. Accepting these terms

By creating an account or using InControl, you agree to these terms. If you're using InControl on behalf of a company or another organization, you're confirming that you have the authority to accept these terms for it, and "you" means that organization. If you don't agree, don't use the service.

You must be at least 13 years old to use InControl.

2. The service

InControl is a project planning application. You give it a date that matters and a description of what you're doing, and it helps you work backward into a plan: tasks and phases with dates, a budget, documents, and vendors. It includes AI features — a planning pass that drafts a plan, an assistant you can chat with about the project, a risk check, and an optional research step that reads public web pages.

We're still building it. Features can change, be added, or be removed. We'll try not to surprise you with removals that matter.

3. Your account

  • Give accurate information when you sign up, and keep it current.
  • Keep your credentials to yourself. You're responsible for what happens under your account, including anything done by someone you gave access to.
  • Tell us promptly at hello@getincontrol.com if you believe someone else has gotten into your account.
  • One person, one account. Don't share a login as a way around usage limits.

4. Acceptable use

While using InControl, don't:

  • break the law, or use the service to plan or carry out anything unlawful;
  • upload or generate content that infringes someone's rights, or that is harassing, hateful, or sexually exploitative;
  • abuse the AI features — for example, using them as a general-purpose model endpoint unrelated to planning a project, trying to extract the underlying prompts or models, deliberately trying to make the assistant produce harmful output, or pointing the research feature at pages you have no right to fetch;
  • scrape, bulk-export, resell, or redistribute the service or anything it produces as a competing or derivative product;
  • probe, overload, or interfere with the service or its infrastructure, or try to get at data that isn't yours;
  • circumvent usage limits, rate limits, or access controls.

We may suspend or limit an account that's causing harm to the service or to other people, and we'll tell you why when we reasonably can.

5. Your content

Your projects, tasks, budgets, notes, documents, and everything else you put into InControl are yours. We don't claim ownership of them.

To run the service, we need a narrow license: you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process your content solely to operate, secure, and improve the service for you — including sending relevant parts of it to the AI models that power the planning and assistant features, as described in our Privacy Policy. That license ends when you delete the content or your account, except for copies in routine backups that age out on their normal schedule.

You're responsible for the content you upload: that you have the right to it, and that it doesn't break the rules in section 4.

6. AI features

InControl's AI features are genuinely useful and genuinely fallible. Please read this section rather than skimming it.

  • Output can be wrong. The assistant, the generated plan, the risk check, and any research summary are suggestions produced by a language model. They can be incomplete, out of date, or confidently incorrect. Verify anything you're going to act on — dates, costs, legal or regulatory requirements, vendor claims, anything with money or a deadline attached.
  • It isn't professional advice. Nothing InControl generates is legal, financial, tax, medical, or engineering advice, and it is not a substitute for a professional who is accountable to you.
  • Research fetches public pages on your behalf. When you ask for research, our servers request public web pages and search results and feed what they find back to the model. We don't control those pages, don't endorse them, and can't vouch for what they say. Treat their content as unverified.
  • Usage limits apply. AI calls are metered per account so that one user can't exhaust capacity for everyone. If you hit a limit, you'll be told, and it'll reset shortly.
  • Similar output for other people. Models produce similar answers to similar questions. We don't promise that output generated for you is unique, and we don't claim ownership of it — as between you and us, output generated from your project is yours, subject to these terms.

7. Availability and warranties

We make reasonable efforts to keep InControl available, fast, and correct, but the service is provided "as is" and "as available", without warranties of any kind, whether express or implied — including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

We don't promise a specific uptime. Planned maintenance, third-party outages, and bugs happen. Keep your own copy of anything you can't afford to lose.

8. Limitation of liability

To the fullest extent the law allows, neither we nor our suppliers are liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption — even if we were told such damages were possible.

Our total liability to you for all claims relating to the service is capped at the greater of (a) the fees you actually paid us for the service in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). If you haven't paid us anything, (b) is the cap.

Some jurisdictions don't allow certain exclusions or limitations; in those places, these limits apply only as far as the law permits.

9. Termination

You can leave at any time. Delete your projects from inside the app, and email hello@getincontrol.com from your account address to have the account itself deleted. That removes your projects and content from our systems as described in the Privacy Policy.

We may suspend or terminate your account if you materially violate these terms, if your use puts the service or other users at risk, or if we're required to by law. Where it's reasonable and lawful to do so, we'll warn you first and give you a chance to fix the problem, and to export your data.

We may also discontinue the service entirely. If we do, we'll give you reasonable advance notice and a window to export your data.

Sections 5 (as to the license surviving in backups), 7, 8, 10, and 11 survive termination.

10. Fees and changes to these terms

InControl is currently free to use. If and when paid plans launch, pricing and billing terms will be published on the pricing page, and refunds are covered by our Refund Policy. We won't start charging you for something that was free without asking you first.

We may update these terms. If a change is material, we'll give you notice — by email or in the app — before it takes effect. Continuing to use InControl after a change takes effect means you accept the updated terms. The "last updated" date at the top always tells you when this version was published.

11. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute that isn't resolved informally, and each of us waives any objection to venue there.

Talk to us first. Before filing anything, email hello@getincontrol.com with a description of the problem and what you'd like to happen. Most things are fixable in a few messages, and we'll try in good faith to resolve it within 30 days.

12. The rest

  • These terms, together with the Privacy Policy and the Refund Policy, are the entire agreement between us about InControl.
  • If any part of these terms is unenforceable, the rest stays in force and that part is narrowed to the minimum extent needed.
  • Not enforcing something once doesn't waive our right to enforce it later.
  • You may not assign these terms without our consent; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.
